1. INTRODUCTION Welcome to Neyy Foods. By downloading, accessing, or using the Neyy application, you agree to be bound by these Terms & Conditions.

2. ROLE OF THE PLATFORM (INTERMEDIARY STATUS) Neyy operates exclusively as a digital intermediary connecting customers with independent home chefs ("Vendors") and facilitating delivery logistics. Neyy does not cook, prepare, package, or own the food items. The contract of sale for any food item is strictly a bipartite agreement between you (the Customer) and the respective Vendor.

3. ALLERGENS AND DIETARY PREFERENCES While Vendors are required to list ingredients accurately, Neyy does not guarantee that any food item is entirely free from allergens or cross-contamination. Customers with severe food allergies or specific dietary requirements must exercise personal caution. Neyy assumes no liability for adverse health reactions.

4. ORDERS AND PAYMENTS

  • Scheduled Deliveries: Neyy operates on a pre-scheduled delivery model (e.g., Breakfast, Lunch, Dinner slots). Orders must be placed before the designated cut-off times for each slot.

  • Pricing: All food prices are listed by the Vendor. Neyy may charge additional fees such as Delivery Fees, Packaging Charges, and Platform Fees, which will be displayed at checkout.

  • Payment: Payments must be made via the methods available in the App (UPI, Cards, Wallets, or Cash on Delivery).

  • Order Acceptance: Your order is a request. The Vendor accepts it based on capacity. If a Vendor is unable to fulfill an accepted order after you have paid, we will process a full refund.

5. CANCELLATION AND REFUNDS

  • Customer Cancellation (Strict Window): Because food is prepared to order for specific scheduled slots, you may only cancel an order before the order-freeze window closes (typically 60 minutes before the delivery slot begins). Once the freeze window closes and the Vendor begins preparation, cancellations are not permitted to prevent food wastage.

  • Refunds: If items are missing, completely incorrect, or of verifiably poor quality (e.g., spoiled or containing foreign objects), we will refund the amount for those specific items. Customers must report such issues with photographic evidence within 24 hours of delivery.

  • Refunds are not provided for "Taste," "Portion Size," or "Preference" issues, as taste is subjective.

  • All refund decisions made by Neyy are final and binding.

6. USER CONDUCT You agree NOT to:

  • Use the App for any illegal or fraudulent purpose.

  • Harass, abuse, or threaten Chefs, Delivery Partners, or Neyy Support Staff.

  • Create multiple accounts to misuse promo codes or referral bonuses (We reserve the right to instantly ban such accounts and recover lost funds).

  • Reverse engineer or attempt to copy the App’s source code.

7. INTELLECTUAL PROPERTY All content on the App, including the Neyy logo, design, software code, and interface, is the exclusive intellectual property of Neyy. You are granted a limited, non-transferable license to use the App for personal, non-commercial use only.

8. DISCLAIMER OF WARRANTIES The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

  • Food Quality: We do not guarantee the quality, safety, or exact preparation methods of the food prepared by Vendors, though we strive to onboard only FSSAI-compliant Chefs.

  • Availability: We do not guarantee that the App will function without interruptions, delays, or technical errors.

9. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Neyy shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of your use of the Services, including but not limited to health issues resulting from food consumption, allergic reactions, or logistical delivery delays. Under no circumstances shall Neyy’s aggregate liability to you for all claims arising out of or related to an order exceed the total amount paid by you for that specific order.

10. GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kochi, Kerala.
