1. INTRODUCTION
Welcome to Neyy ("Company", "We", "Us"). By downloading or using the Neyy mobile application (the "App") or website, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you ("User", "Vendor", or "Delivery Partner") and Neyy (operating under Neyy) regarding your use of the Platform.
2. OUR ROLE (CRITICAL NOTICE)
Neyy is a technology platform that connects:
Customers seeking food delivery.
Home Chefs / Vendors who prepare the food.
Delivery Partners who transport the food.
Important Disclaimer: Neyy is an online marketplace (intermediary). We do not prepare food, and we do not provide delivery services directly. The quality, hygiene, and quantity of the food are the sole responsibility of the Vendor (Chef). The timeliness of the delivery is the responsibility of the Delivery Partner.
3. ACCOUNT REGISTRATION
Eligibility: You must be at least 18 years old to use the Services.
Accuracy: You agree to provide accurate information (Name, Phone Number, Address) during registration.
Security: You are responsible for maintaining the confidentiality of your login credentials (OTP/Password). You are liable for all activities that occur under your account.
4. ORDERS AND PAYMENTS
Pricing: All food prices are listed by the Vendor. Neyy may charge additional fees such as Delivery Fees, Packaging Charges, and Platform Fees.
Payment: Payments must be made via the methods available in the App (UPI, Cards, Wallets, or Cash on Delivery).
Order Acceptance: Your order is a request. The Vendor accepts it based on availability. If a Vendor cancels an order after you have paid, we will process a refund.
5. CANCELLATION AND REFUNDS
Customer Cancellation: You may cancel an order only before the Vendor accepts it. Once the Vendor starts preparing the food, cancellations are not permitted to prevent food wastage.
Refunds:
If items are missing or completely wrong, we will refund the amount for those specific items.
Refunds are not provided for "Taste" or "Preference" issues, as taste is subjective.
All refund decisions made by Neyy are final.
6. USER CONDUCT
You agree NOT to:
Use the App for any illegal purpose.
Harass, abuse, or threaten Chefs or Delivery Partners.
Create multiple accounts to misuse promo codes or referral bonuses (We reserve the right to ban such accounts).
Reverse engineer or attempt to copy the App’s source code.
7. INTELLECTUAL PROPERTY
All content on the App, including the Neyy logo, design, software code, and interface, is the intellectual property of Neyy. You are granted a limited license to use the App for personal, non-commercial use only.
8. DISCLAIMER OF WARRANTIES
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
Food Quality: We do not guarantee the quality or safety of the food prepared by Vendors, though we strive to onboard only compliant Chefs.
Availability: We do not guarantee that the App will function without interruptions or errors.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Neyy shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services, including but not limited to health issues resulting from food consumption or delivery delays.
10. GOVERNING LAW
These Terms shall be governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Kochi, Kerala.
